Landowner Fined for Violating Solid Waste Management Rules
Montpelier, Vt. – The Agency of Natural Resources (ANR) Department of Environmental Conservation (DEC) announced today that Americanadian LLC, owner of a commercial property in St. Albans, was fined $4,000 for storing and disposing solid waste on their property without required certifications and approvals. The investigation was conducted by an Environmental Enforcement Officer with ANR.
DEC’s Waste Management and Prevention Division oversees the use, treatment, and handling of hazardous and solid wastes. The Solid Waste Management Rules establish procedures and standards to protect public health and the environment by ensuring the safe, proper, and sustainable management of solid waste in Vermont. The rules prohibit the treatment, storage, or disposal of solid waste outside of a certified facility.
“It is important to properly dispose of solid waste, including debris from construction, renovation, or demolition, to prevent toxic chemicals from seeping into the soil and contaminating water supplies and to prevent waste from attracting vermin and littering neighboring properties,” says Jason Batchelder, DEC Commissioner. “DEC has free resources to help property owners if they are unsure about what to do with waste on their property or how to find a permitted hauler or facility.”
In January 2024, construction and demolition waste, including treated wood, furniture, and wooden siding, was observed in a field on a piece of property owned by Americanadian LLC. Despite the landowner removing and properly disposing of approximately 6 tons of waste materials in February and March 2024, solid waste remained and was observed on the property in September 2024.
The landowner agreed to pay a fine of $4,000 for the violation. It also agreed to promptly remove all waste material from the property and properly dispose of it at a certified solid waste facility. This agreement was incorporated into a Final Judicial Order of the Vermont Superior Court, Environmental Division on April 28, 2025.
